L1-A Visa Timelines
EntryOpen outlines each major phase in the L-1A visa petition process for US business expansion - from checklist and document gathering to petition preparation, USCIS processing, approval, and visa stamping.
Please note that timelines may vary depending on case complexity, responsiveness during document collection, and country-specific consular appointment availability.
1. Initial Phase: Checklist & Document Gathering
- Timeframe: 3 - 4 weeks (variable)
- Based on the L1-A visa checklist, the beneficiary and foreign employer begin collecting supporting documentation.
- Initial documents are submitted for our evaluation.
- Back-and-forth communication may occur to request missing or clarifying documentation.
2. Petition Preparation & Review
- Timeframe: 3 - 4 weeks (after document collection is complete)
- Our team drafts the L-1A petition, support letter, company materials, and organizational structure.
3. USCIS Petition Filing
- Once finalized, the petition is submitted to USCIS (Form I-129 + L Supplement).
a. Premium Processing (Optional)
USCIS adjudicates within 15 business days. (It is taking more time in the current scenario)
b. Regular Processing
Estimated timeframe: 3 - 4 months, subject to USCIS caseload.
If additional evidence is requested (RFE), in both cases above, processing will resume after the RFE response is submitted.
RFE Timeline to respond is 90 days - we have to analyze and respond within this time.
4. Post-Approval: Consular Processing
- Timeframe: 2 - 4 weeks (after USCIS approval)
Once the petition is approved, the following steps are required for visa stamping:
a. Form DS-160 Preparation & Submission: The beneficiary completes and submits the DS-160 online visa application form.
b. Visa Appointment Scheduling: Schedule a visa interview at a U.S. Embassy or Consulate in the beneficiary’s country.
The wait times for interview slots vary by location and time of year (3–8 weeks typical, but can be longer).
c. Mock Interview Preparation (Optional but Recommended): Beneficiary may undergo one or more mock sessions to prepare for the consular interview.
Covers common L-1A questions and best practices for interview confidence.
5. Visa Interview & Stamping
- Attend the visa interview with original documentation and interview letter.
- If approved, the passport is typically returned with the visa stamped within 3–10 business days, depending on consulate operations.
